Canada is the largest trading partner of the U.S., ranking ahead of China, Mexico, and Germany. As a result, it is of critical importance for lawyers to understand differences and similarities in how these two legal orders regulate privacy and security. This session will provide a practical “compare and contrast” on key elements of current Canadian and U.S. laws concerning privacy, cybersecurity/breach response and electronic telemarketing. It will also predict likely future changes and opportunities for engagement in shaping law, including the proposed strengthening of Canadian privacy law in light of GDPR and the increased potential for U.S. federal legislation in light of the California Consumer Privacy Act of 2018.
