Screening job applicants and independent contractors through pre-employment background checks and ferreting out employees who have “turned” post-hire are fundamental elements of an insider threat reduction program. However, the “ban-the-box movement” and hundreds of recently filed class action lawsuits alleging violations of the federal Fair Credit Reporting Act have ratcheted up the risk for employers who engage in these activities. This session will provide practical advice on how to eliminate the insider threat through an effective pre- and post-hire background check program without being sued.
