This presentation will consider practical challenges to data use and sharing under HIPAA and GDPR, including effectively using such data to improve overall care, and obtaining appropriate authorizations and consents for use and re-use of such information.
One of the key challenges is that most regulations designed to permit sharing of information, such as TEFCA, as well as state and privately supported HIEs and other data banks presume compliance with HIPAA and state privacy laws—which in fact is the underlying challenge to appropriately sharing such data.
